Maschinenbau-Institut GmbH ("Organizer“)
The following conditions apply to contracts between the organizer and the respective contract partner. They apply exclusively. Any terms and conditions deviating from these terms and conditions shall have no validity.
Early registration is recommended. The participation fee is due at the latest by the beginning of the event, but not before receipt of the invoice.
The organizer is liable within the scope of the fulfillment of his contractual obligations only for his own intentional or grossly negligent breaches of duty or those of his legal representatives or his vicarious agents. In the event of a breach of an essential contractual obligation, there is comprehensive liability, but in the case of slight negligence, liability is limited to reasonably foreseeable damage typical of the contract. This does not affect the liability of the organizer or his legal representatives or his vicarious agents for damages resulting from culpable injury to life, body or health and for the observance of any guarantee promises.
The registration is the basis of the organizer's resource planning. When booking speakers, event tools, etc., the organizer must make arrangements in good time in order to be able to realize a good quality event at reasonable prices. Therefore, the registration for a business event must be regarded as binding. Should a cancellation nevertheless be made, the following cancellation conditions apply: Cancellation must be made in writing. For cancellations up to 2 weeks before the event the organizer charges 150,00 € - plus VAT for expenses already incurred. For cancellations after this date as well as for non-appearance, fees amounting to 100% of the regular participation fee plus VAT must be paid. A substitute participant can be named free of charge. The contractual partner reserves the right to prove that the organizer has suffered a lesser loss. The organizer reserves the right to relocate, change or cancel the entire event or individual parts of it at short notice.
4. program changes:
In exceptional cases, the organizer reserves the right to make changes to the program. If the event has to be cancelled for unforeseen reasons, an immediate notification will be sent. In this case the organizer is only obliged to refund any fees already paid. In all other respects clause 2 shall apply.
5. image and sound recordings:
Image or sound recordings within the scope of an event require the prior written consent of the organizer in any case. The same applies to any subsequent use of image or sound recordings of the event.
6. event documents/documentation:
Any transfer of use of event documentation and training documents to third parties, whether against payment or free of charge, requires the prior written consent of the organizer.
7. data protection notice:
The collection, processing and use of the personal data of the contractual partner is carried out under strict observance of the basic data protection regulation and the German Federal Data Protection Act. Any use and processing of such data shall be exclusively for handling and billing purposes and for the purpose of sending information material of the VDMA Group and Maschinenbau-Institut GmbH to Contract Partner by mail or e-mail. The VDMA Group may also contact the contracting party directly. The contracting party may object to the processing and use of its personal data for the purpose of informing it about current offers of the VDMA Group and Maschinenbau-Institut GmbH at any time with effect for the future. 8. publication of participant lists:
Within the framework of our events, we intend to provide participants with a list of participants, including the names and positions of the participants as well as the name and location of the participants' company. If you do not agree with the inclusion of your data on the list of participants, please contact firstname.lastname@example.org.
9. inventory regulation:
Should individual provisions of these terms and conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of the contract.
10. place of jurisdiction/choice of law:
The place of jurisdiction for all disputes arising from the contract between the organiser and the contractual partner is the organiser's registered office, Frankfurt am Main, Germany, if the contractual partner is a merchant, legal entity under public law or special fund under public law.
